Justin...you are correct, however it doesn't matter.  Read the books by Otto Skinner for a more in-depth view of how things work regarding the Income Tax.  I've read Cracking the Code and, while good, it's not the do-all/be-all of taxation.  Also, it is the perfect example of how big of a bully the government is...just because you're right won't stop them from coming after you and taking everything you have in court expenses and, quite possibly, jail time.  The author is himself duking it out in court...as are the numerous people who have followed his book and gotten refunds from the IRS.

Otto Skinner tends to rub a lot of people the wrong way because he pokes holes in some of the most popular "tax protestor" arguments.  In fact, he makes note of a whopping 18 "flawed arguments" to watch out for.  By flawed, he simply means that these arguments have been heavily ruled against and are, many times, not central to the most important argument that the income tax is actually a perfectly legal indirect/excise tax that has simply been enforced illegally with deceptive wording.

It is also interesting to note the numerous lower court rulings (which have put people in jail, by the way) that actually contradict each other...some cases have held that the income tax is a direct tax, others have held that it's an indirect tax, others held that the 16th Ammendment gave Congress new taxing powers while others have held that it didn't!

So despite all this legal contradiction and falsehoods that disagree with earlier Supreme Court rulings, the government continues harrassing and imprisoning perfectly innocent "tax protestors".  I myself will never again pay another penny in income taxes, but then again, I'm leaving the country.  Being right doesn't mean anything anymore.  I'm still voting for Ron Paul and I pass on as much information as I can about him, but I think the writing is on the wall.

I understand your position but leaving the country is like delaying the inevitable. The fight for freedom is here in these united States. Ron Paul has sacrificed a comfortable lifestyle to take on the powers that be and has inspired countless others, including myself, to stay and fight the good fight.
It is time to participate and live without fear.
Remember, these are just people who support an ideology of force and control. We CAN win by spreading the words of truth. It is happening already.
As for Peter Hendrickson's situation. He is is a position of power in District Court right now. They are stalling because they have no answer for him. It is the preeminent contest in the tax freedom movement. When he wins it will open the flood gates that will, once and for all, expose the IRS for what it is - a collection agency for the Federal Reserve. When this happens  the  house of cards will crumble  and our political regime in Washington will no longer have the power to wage illegal wars across the globe because Americans will no longer pay off the loan interest from the Fed which funds these entanglements.
